Terms of service

The contract between you and anyping.

1. Acceptance

By creating an anyping account, accessing the service, or using our APIs, you agree to these terms. If you're agreeing on behalf of a company, you represent that you have authority to bind that company.

2. The service

anyping provides web-based uptime monitoring: scheduled checks of URLs, hosts, and ports; alerting on failure; status pages; and related tooling. The exact features available depend on your plan (see pricing).

We continuously improve the service. We may add, modify, or remove features with reasonable notice. If we materially reduce a feature you depend on, you may cancel and receive a prorated refund.

3. Acceptable use

You may monitor any system you own or have explicit permission to monitor. You may not use anyping to:

  • Conduct unauthorized scans, probes, attacks, or stress tests against systems you don't control.
  • Send spam, bulk unsolicited communications, or anything illegal under applicable law.
  • Reverse-engineer, decompile, or attempt to extract source code from the service.
  • Resell or repackage the service without a written reseller agreement.
  • Interfere with the service's operation or other users' use of it.
  • Misrepresent the source or nature of monitoring traffic.

We reserve the right to suspend or terminate accounts that violate this section. For high-volume webhook abuse or scraping, we may impose rate limits without notice.

4. Your account

You're responsible for:

  • Keeping your credentials secure (use unique passwords; enable MFA).
  • All activity under your account, including by team members you invite.
  • Notifying us immediately at security@anyping.com if you suspect unauthorized access.
  • Maintaining accurate billing information.

5. Billing & payment

5.1 Plans & pricing

Pricing is shown on the pricing page. Plans are billed monthly or annually in advance. Annual plans get the equivalent of two months free.

5.2 Charges

You authorize us to charge your payment method on each billing date for the plan you've selected. If a charge fails, we'll retry over several days and email you. If charges keep failing after notice, we'll downgrade or suspend the account.

5.3 Refunds

If anyping doesn't work out within your first 30 days of paid use, email hello@anyping.com and we'll refund the charge in full — no fine print, no questions. After 30 days, fees are non-refundable except where required by law.

5.4 Plan changes

You can upgrade anytime; charges are prorated to the day. Downgrades take effect at the end of your current billing cycle. If you cancel, you keep access through the end of the current cycle.

5.5 Taxes

Prices are exclusive of applicable taxes. Where we're required to collect VAT, sales tax, or similar, it'll be added at checkout.

6. Termination

You can cancel from your dashboard anytime. Cancellation takes effect at the end of your current billing period; you keep access through that date.

We can terminate accounts that materially violate these terms after 7 days' notice (or immediately for security-related violations). On termination for breach, fees are non-refundable.

On termination, we'll keep your data for 30 days before deletion, in case you want to come back.

7. Service-level expectation

We aim for 99.9% monthly uptime on the anyping service. "Uptime" excludes scheduled maintenance (announced at least 48 hours in advance, generally during off-peak windows) and force-majeure events.

If we miss the SLA in a given month, contact hello@anyping.com within 60 days and we'll credit your account proportionally:

  • 99.0% – 99.9% uptime: 10% credit on that month's bill.
  • 95.0% – 99.0% uptime: 25% credit.
  • Below 95.0% uptime: 50% credit.

Credits are the sole remedy for SLA misses.

8. Intellectual property

anyping (the software, brand, design, and documentation) is our property and our licensors'. We grant you a limited, non-exclusive, non-transferable license to use it during your subscription.

Your content (account info, monitor configs, status-page content, incident notes) remains yours. You grant us only the rights necessary to operate the service for you.

9. Confidentiality

Both parties may receive confidential information from the other. Each party agrees to protect the other's confidential information with the same care it uses for its own (and at minimum, reasonable care), and not to disclose it except to employees and contractors who need to know and are bound by similar confidentiality obligations.

10. Warranties & disclaimer

We warrant that the service will substantially perform as described in the documentation. Otherwise, the service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of or related to these terms or the service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including lost profits or revenue, even if advised of the possibility.

Some jurisdictions don't allow these limits; in that case, they apply only to the extent permitted.

12. Indemnity

You'll defend and indemnify us against claims arising from your use of the service in violation of these terms or applicable law, or from your monitored content infringing a third party's rights.

13. Governing law & disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflicts of law. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Delaware. Both parties waive any right to a jury trial.

Before filing suit, please email legal@anyping.com — we will genuinely try to resolve disputes informally first.

14. Changes to these terms

If we change these terms materially, we'll email all account holders at least 30 days in advance. Continued use after the effective date means you accept the new terms. If you don't accept, you can cancel and receive a prorated refund of any prepaid fees.

15. General

  • Entire agreement — these terms (plus the privacy policy and any plan-specific addendum) are the complete agreement between us.
  • Assignment — you can't assign these terms without our written consent. We can assign in connection with a merger, acquisition, or sale of all/substantially all of our assets.
  • Severability — if any provision is unenforceable, the rest stays in effect.
  • No waiver — failure to enforce any provision isn't a waiver of our right to enforce it later.
  • Force majeure — neither party is liable for delays or failures caused by events outside reasonable control.
